The principle of "common but differentiated responsibilities" solidified Global Solidarity for Climate Change Responsibility, the idea that while each state bears different responsibilities and contributes differently to environmental deterioration, States and Foreign Investors all share the need to act to mitigate those adverse impacts. The Rio Principles 7 and 8 urge international cooperation "in the spirit of global partnership" to conserve and safeguard the Earth's ecosystem. In this article, the interfaces of Investor-State Dispute Settlement, International Environmental Law, and their nexus on building effective Transnational Investment under the aegis of Global Solidarity on Climate Change in the broader context of the 2015 Paris Agreement implementation are examined, specifically on the Anthropocene Epoch and the code red of Climate Change, and the drive for global climate solidarity in transnational investment.
The growing concern about Climate Change and its destabilizing repercussions in the global landscape necessitates the duty of all humanity to address structural deficiencies in the current Investor-State Dispute Settlement through global solidarity consistent with the United Nations Human Rights Council Report A/HRC/38/40 on the intersection of human rights-based global solidarity in responding to Climate Change. There is an urgent need to move from current International Law to Transnational Law in the global economy, decoupling fossil fuel emissions and sustainable investment through Investor-State Dispute Settlement.
