A pillar of Indian trademark law, deceptive similarity shields customers from confusion about the origin or source of goods and services. One method of trademark infringement or misuse is the use of a "deceptively similar" trademark. As a result, consumers are unable to distinguish between a legitimate trademark product and one that is confusingly similar. As a result, the reputation and goodwill of a legitimate trademark holder are still in jeopardy, and the goodwill of the legitimate trademark holder is exploited by someone who uses the trademark fraudulently. The purpose of this research paper is to examine the meaning of deceptive similarity as it pertains to the Trade Marks Act in India, including its inception, evolution, historical context, and notable rulings regarding deceptive similarity between Indian trademarks and how it is affected by the development of artificial intelligence (AI).
