Abstract: "If you cannot control your reproduction, you cannot control your life." -Joycelyn Elders Ending Unwanted pregnancies is a legal problem for women in every country, in both the first and second worlds. People from different countries have discussed abortion as a controversial right in national and international settings. It is also often turned into a political issue and shown to the public as something that is naturally hostile or provocative. Thus the right to abortion has become an incoherent amalgamation of moral, spiritual, and legal conquests . Legislature and court have frequently battled to find a balance between pregnant mothers' and foetuses' rights. As in India, abortion and women's reproductive autonomy contradict foetal personhood. Even though the Indian judiciary is making women's access to abortion more liberal and is attempting to harmonize statutes with special case facts, these efforts have not been successful. The purpose of this study is to provide a comparative analysis of the abortion laws and policies in India and the United States. This will be accomplished by analyzing the extent to which the MTP Act in India has enabled Indian women to exercise their freedom to make decisions regarding their bodies and how one overturned judgement by the Supreme Court of the United States is robbing women of the USA of this very human right.
