| Abstract: | The Constitution of India says that “No person shall be deprived of his life or personal liberty except according to procedure established by law, nor shall any person be denied equality before the law or the equal protection of the laws within the territory of India". It also covers a just and fair trial without any arbitrary procedure, which confers that arrest should not only be legal but also justified. All legal systems provide certain standards for the rights of the accused. The idea has been developed in human rights law and adopted both on the national and international levels. Universal Declaration of Human Rights, 1948 has acknowledged the rights of an accused person. The International Covenant on Civil and Political Rights, 1966 has also accepted in its provisions the right of an accused. Universal Declaration of Human Rights, International Covenant on Civil and Political Rights and on the other hand international criminal proceedings regulations in International Criminal Tribunal, and International Criminal Court and International Court of Justice Statutes. The main aim of the present paper to know more about the rights of the accused under the different statutes and there are certain important case laws cited by Supreme Court regarding the rights of the accused. |
