This essay examines how the laws in India have changed to deal with sexual harassment, with particular attention to the Vishaka case that led the court to publish guidelines in the absence of new laws. The Vishaka standards identified sexual harassment, required preventive actions, and emphasized the importance of workplace safety. However, the impact was little due to the absence of statutory support and enforcement measures. The essay follows the drawn-out legislative process that resulted in the 2013 Sexual Harassment of Women at Workplace Act. It criticizes the legislative action's delay and highlights the judiciary's responsibility for defending fundamental rights.
