Abstract: This special paper presents a sustainable approach to conflict resolution in Ghana and beyond. It proposes that ‘Getting to Yes’ is no longer adequate in this era where emphasis is laid on sustainability in the results of conflict resolution mechanisms including mediation and arbitration. In ‘Getting to Yes,’ the authors provided a strategy to resolve conflicts through negotiation and mediation which yielded results in the past. However, some conflicts that were supposed to have been resolved in the past keep recurring. There is therefore, the need to employ an approach that brings about a more lasting solution for future generations to peacefully co-exist. Accordingly, this study posits that the application of ‘Getting to Yes’ approach falls short of the ability of the parties to arrive at lasting solutions using creative and innovative approaches. To bridge this gap, extant related literature is reviewed, and primary data collected from 10 experienced ADR practitioners to complement secondary data using structured interviews. The results show that ‘Getting to Yes’ is no longer enough for sustainability of mediation and arbitration outcomes. The study proposes a sustainable conflict resolution/management model to bridge the identified gap. The study therefore, concludes by suggesting that ADR practitioners should consider factoring into their techniques, innovative, and creative ways of resolving conflicts including the maxim use of resources for sustainable outcomes.
